SHAFIA : LA MÈRE CHANGE SA VERSION...

Tooba Mohammad Yahya, soupçonnée d'avoir tué ses trois filles et la première femme de son époux, a changé peu à peu sa version des faits au fil de son interrogatoire de six heures, alors que l'enquêteur tentait de susciter chez elle un sentiment de culpabilité maternelle, a appris un tribunal ontarien, mercredi.

Dans l'enregistrement de l'interrogatoire visionné par la cour, le détective suggère par la suite que la nouvelle histoire de Yahya manque tout autant de crédibilité que la première. La femme âgée de 41 ans, son époux Mohammad Shafia et leur fils, Hamed Mohammad Shafia, âgé de 20 ans, ont plaidé non coupable à quatre chefs d'accusations de meurtre prémédité. Les corps de Zainab, âgée de 19 ans, Sahar, âgée de 17 ans, et de Geeti, âgée de 13 ans, ainsi que celui de la première épouse de Mohammad Shafia, Rona Amir Mohammad, âgée de 50 ans,

ont été retrouvés dans une voiture submergée dans le canal Rideau en juin 2009, à Kingston, en Ontario. La famille, établie à Saint-Léonard, était de retour d'un périple à Niagara Falls lorsqu'elle s'est arrêtée dans un motel aux petites heures du matin, le 30 juin, après avoir été sur la route depuis 18 h. Les trois accusés ont été interrogés par les policiers ce jour-là, et le vidéo les montre expliquant aux agents que Zainab, qui n'avait pas son permis de conduire, avait pris les clés de leur voiture pour faire une balade. Le fait que la Nissan Sentra se soit retrouvée au fond du canal n'est rien d'autre qu'un terrible accident, selon les Shafia.

Mais après des semaines d'enquête, appuyées par l'utilisation de dispositifs d'écoute électronique, la police a conclu que les Shafia s'étaient servis de leur VUS Lexus pour pousser la Nissan, avec à son bord les quatre victimes, dans le canal. La couronne allègue que les adolescentes avaient "déshonoré" leur famille en ayant des petits amis. Yahya, Shafia et Hamed ont été arrêtés le 22 juillet 2009. Le policier qui a mené l'interrogatoire, "prêté" par la Gendarmerie royale du Canada parce qu'il connaît la langue farsi, a confronté Yahya à propos d'incohérences dans sa version du fil des événements.

Dans les premières minutes de l'enregistrement, Yahya pleure avant l'arrivée de l'enquêteur, en regardant et en embrassant les photos de ses filles. Dans la salle d'audience mercredi, Shafia pleurait, le visage enfoui dans un mouchoir et les épaules secouées par les sanglots, alors qu'il regardait les images de sa femme en pleurs. Pendant la majeure partie de l'interrogatoire, le policier Shahin Mehdizadeh a reconstitué l'histoire de Yahya, soulignant les preuves qui démontraient l'incongruité de sa version et l'accusant de lui mentir. "Ce n'est pas un accident, madame. Vous savez ce qui s'est passé là-bas. Je ne veux pas de mensonges. Je ne veux pas entendre le mensonge que Zainab ait pris les clés et qu'ensuite vous ne l'ayez plus revue", a dit le policier Mehdizadeh.

"Quelqu'un a joué à Dieu ce soir-là et a décidé que ces trois filles et cette femme devaient être tuées. Lorsqu'ils ont fait ce boulot, ils ne l'ont pas fait correctement, je vous le dis", a-t-il poursuivi. Peu à peu, la femme a nuancé ses propos mais a demandé à l'agent de ne pas le dire à son mari. Elle a admis qu'ils étaient tous les trois au canal cette nuit-là et a tenté de jeter le blâme à Mohammad Shafia, soutenant qu'elle et son fils marchaient lorsqu'ils ont entendu un bruit sourd avant de voir la voiture plonger dans l'eau. C'est à ce moment-là qu'elle s'est évanouie, a affirmé Yahya.

"Lorsque je suis arrivée au motel je ne croyais toujours pas que les filles aient pu tomber dans l'eau. Je me disais que leur papa était déjà allé les chercher. Je pensais de cette façon-là, vous comprenez?", a lancé Yahya. L'enquêteur Mehdizadeh lui a alors dit que c'était "impossible". La police sait qu'Hamed n'est pas resté au motel de Kingston la nuit de la tragédie, et qu'il s'était plutôt rendu à Montréal, où il a frappé un poteau dans un stationnement, selon ce qu'a rapporté l'agent Mehdizadeh.

Le jeune homme a contacté les policiers pour rapporter la collision le matin du 30 juin, mais la couronne plaide que cet accrochage a été provoqué pour expliquer les dommages subis par la Lexus lorsque cette voiture a poussé la Nissan dans le canal. Le policier Mehdizadeh a dit ne pas croire à la version des faits rapportés par Yahya, ni comprendre comment Hamed a pu négliger d'appeler la police après avoir vu quatre personnes plonger dans l'eau à l'intérieur d'une voiture, mais pris la peine de rapporter immédiatement un incident mineur n'impliquant qu'un seul véhicule.
